The study of the 'the tenure, the termination and the processual justice in the defence forces' of India is, essentially a journey into the past and the present systems of administration, which drew heavily from the customs and usage of the service. The consituent assembly took more than two years in framing the constitution of India which acquired the distinction of being the longest written constitution in the world. The provisions for recruitment, appointment and removal were made a part and parcel of the constitution itself. The defence forces which were governed by the erstwhile "Article of War", and an essortment of customary practices, too were given their respective statutes. This was the affirmation of the evolutionary trend in the laws relating to the holding of appointments, tenure of service, terminations and removals from service in the defence forces.
